When an application, response, appeal paper, or other substantive work has already been prepared, HPC can provide practitioner-level filing support or substantive U.S.-practice review without requiring HPC to redo substantive work that is already complete.

Two Service Levels

The level of review depends on what you need HPC to do

Supplied-work matters are divided into two service levels so the scope of HPC's substantive review is clear from the outset.

Level 1

Filing-/Submission-Ready

You supply substantially completed documents and filing instructions. HPC performs the practitioner-level review and formalities needed to responsibly make the requested USPTO filing or submission, or to return the package in final form for filing.

  • Appropriate when the substantive work is already complete
  • Includes filing formalities and practitioner-level review necessary for the requested submission
  • Does not include an independent substantive U.S.-practice review
Level 2

Substantive Review of Supplied Work

This includes the Filing-/Submission-Ready work and adds substantive U.S.-practice review of the supplied application, claims, response, arguments, amendments, or other substantive work product within the agreed scope.

  • HPC identifies issues that warrant attention
  • Recommended revisions are communicated
  • HPC recommends or makes revisions as agreed

The key distinction is how much substantive U.S.-practice review HPC is being asked to perform. Whether HPC will make the filing or instead return a final package for someone else to file is a separate matter-specific decision.

Examples of supplied-work matters

The model can be used whenever substantive work already exists and the requested HPC role is narrower than preparing the matter from the beginning.

Prepared Application

A U.S. nonprovisional, international (PCT), national-stage, or provisional application is substantially complete and needs U.S. practitioner filing support or review.

Prepared Office Action Response

A response, amendment, or argument has already been drafted and needs filing support or substantive U.S.-practice review before submission.

Prepared Appeal Work

A Pre-Appeal Brief Request or Appeal Brief has already been substantially prepared and needs an appropriate level of practitioner review and submission support.

Two common examples

These examples illustrate how the two service levels are priced for common supplied-work matters.

HPC also handles other supplied-work application, prosecution, and appeal matters. The appropriate service level and matter-specific fee are determined after review of the proposed work.

When supplied work becomes full substantive work

If the supplied materials require substantial rewriting, or if HPC is asked to develop the underlying application, response, or appeal arguments rather than review supplied work, the matter is handled as Full HPC Substantive Service.

An independent prior-art search is not included in either supplied-work service level unless it is expressly included in the written Matter Terms for the engagement.

Who May Use This Service

The service level depends on the work supplied, not on whether the client is a U.S. firm, foreign associate, company, or applicant

U.S. Patent Professionals

For overflow, second-level review, finalization, or filing support when substantive work already exists.

Foreign Patent Professionals

For U.S. filings and submissions when the application, response, or other work was prepared abroad and a U.S. registered patent practitioner is needed, with optional substantive U.S.-practice review when requested.

Companies & Applicants

For matters in which the application, response, or other work is already substantially prepared and a U.S. practitioner is needed for filing or review.

You do not need to choose the service level yourself. During the consultation and follow-up matter review, HPC determines whether the proposed work is Filing-/Submission-Ready, requires Substantive Review of Supplied Work, or should instead be handled as Full HPC Substantive Service.
